Terms of service

1. Who we are

These terms are between you and Webyne Data Center Pvt Ltd, registered in India and operating from Noida, Uttar Pradesh. They cover this website and, unless a separate signed agreement says otherwise, the Webyne AI platforms linked from it.

2. Accounts

You are responsible for the accuracy of the information on your account and for everything done under your credentials. Tell us promptly if you believe an account has been compromised. Some platforms are in controlled release and access is granted by request.

3. Acceptable use

• Do not use the platforms to break the law, infringe the rights of others, or store or distribute unlawful content.
• Do not attempt to bypass tenant isolation, rate limits, spend guardrails or approval requirements.
• Do not probe, scan or load-test the infrastructure without written permission.
• Advertising run through Ads AI must comply with the policies of each channel; those channels remain the final authority on what they will publish.

4. AI-generated output

The platforms generate plans, code, sizing estimates, campaign proposals and database recommendations. These are decision support, not guarantees. Assessment figures are estimates computed from the inputs you provide; the AI DBA is advisory and never changes your production database on its own. You remain responsible for reviewing output before you approve it.

5. Approvals and irreversible actions

The platforms require explicit approval before any high-risk or irreversible action, and step-up authentication for critical ones. Where you choose to promote an action to run automatically, you accept responsibility for actions taken under that setting.

6. Your data

You keep ownership of everything you upload or create. We process it to provide the service, as described in our privacy notice. You are responsible for having the right to place that data with us.

7. Fees and billing

Prices are in Indian rupees and exclude GST, which is invoiced separately against your GSTIN. Subscription tiers are sized for a stated volume — managed ad spend, storage, or instance size — and exceeding that sizing is a reason to move tier, not a switch that stops your service. Metered usage on AI Cloud is billed on compute, GPU-seconds and tokens as the work happens.

8. Availability

We aim for continuous availability and publish an uptime commitment on the plans that carry one. Maintenance that affects service is notified in advance where practical. Features described as on the roadmap are not yet contractual.

9. Suspension and termination

You may stop using a platform at any time; cancellation takes effect at the end of the current billing period unless otherwise agreed. We may suspend an account for non-payment, or immediately where use threatens the security or lawful operation of the infrastructure, and will tell you why.

10. Liability

Nothing here excludes liability that cannot lawfully be excluded. Subject to that, neither party is liable for indirect or consequential loss, and our aggregate liability is limited to the fees you paid for the affected service in the twelve months before the claim.

11. Changes

We may update these terms. Material changes will be notified to the email address on your account before they take effect.
